Welcome to JobFlyte! These Terms of Service (“Terms”, “Agreement”) govern your access to and use of JobFlyte’s SaaS platform, website, products, and services (collectively, the “Services”). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, please do not use our Services.
1. Acceptance of Terms
By creating an account, installing, accessing, or using JobFlyte’s Services, you agree to comply with these Terms as well as our Privacy Policy and all applicable policies incorporated herein by reference.
We may update these Terms occasionally. Continued use after changes constitutes your acceptance of the updated terms. We will notify you of significant updates via email or notification in the platform.
2. Eligibility
You represent and warrant that you are legally capable of entering into contracts and, if applicable, are authorized to act on behalf of the entity using the Services.
The Services are not available to individuals under the age of 16.
3. Account Registration and Security
- To use JobFlyte, you must register for an account and provide accurate, complete information.
- You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
- You agree to notify us immediately of any unauthorized use or suspected breach of your account.
- We reserve the right to suspend or terminate accounts if misuse or unauthorized activity is suspected.
4. License and Use of Services
- Subject to your compliance with these Terms and payment of any applicable fees, we grant you a limited, non-exclusive, non-transferable license to use the Services for your internal business purposes.
- You agree not to:
- Copy, modify, or create derivative works of the Services or intellectual property.
- Reverse engineer, decompile, or disassemble any part of the Services.
- Use the Services to violate laws or infringe third-party rights.
- Interfere with the operation or security of the Services.
- All rights not expressly granted are reserved by JobFlyte.
5. Payment and Fees
- Use of the Services may require payment of subscription fees as set forth in the pricing plans.
- Fees are billed in advance monthly or annually, as selected.
- Payment processing is handled securely by third-party processors (e.g., Stripe). You authorize us to charge your payment method for all applicable fees.
- We reserve the right to change pricing with 30 days’ notice.
- Refunds and cancellations are subject to our refund policy; typically, no refunds will be issued for partial months or unused service periods.
- You are responsible for any taxes related to fee payments.
6. User Content and Data
- You retain ownership of all data and content you upload or input into JobFlyte.
- By using the Services, you grant JobFlyte a license to host, store, and process your data as necessary to provide the Services.
- You warrant that your content complies with all applicable laws and does not infringe third-party rights.
- JobFlyte may suspend or remove content that violates policies or endangers the platform’s integrity.
7. Third-Party Integrations
Our Services may integrate with third-party products and services. Your use of these integrations is subject to the third-party’s terms and privacy policies. JobFlyte is not responsible for the content, functionality, or security of third-party services.
8. Term and Termination
- These Terms remain effective until terminated.
- You may terminate your account anytime by following cancellation procedures.
- We may suspend or terminate your access immediately for breach of these Terms, illegal activity, or abuse.
- Upon termination, your right to use the Services ends, and we will delete or anonymize your data according to our data retention policies.
- Certain provisions (e.g., payment obligations, disclaimers, and liability limits) survive termination.
9. Disclaimers and Limitation of Liability
- The Services are provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement.
- JobFlyte does not warrant that the Services will be uninterrupted, error-free, or completely secure.
- We are not liable for indirect, incidental, special, consequential, or punitive damages arising from your use or inability to use the Services.
- Our aggregate liability for direct damages is limited to the amount you have paid us in the previous 12 months.
- You agree to indemnify and hold harmless JobFlyte from claims arising out of your misuse of the Services.
10. Intellectual Property
- All JobFlyte trademarks, logos, software, and content are our exclusive property or licensed to us.
- You agree not to use our trademarks without our explicit permission.
- User content and data remain your property, subject to the license granted in Section 6.
11. Governing Law and Dispute Resolution
- These Terms are governed by and construed under the laws of the State of Texas, USA, excluding its conflict of law principles.
- Any dispute arising under these Terms will be resolved first by good faith negotiation.
- If unresolved, disputes shall be subject to binding arbitration in Travis County, Texas, under the rules of the American Arbitration Association.
- You waive any right to a trial by jury or participation in a class action.
12. Changes to Services
JobFlyte reserves the right to modify, suspend, or discontinue any feature or the entire Services at any time with or without notice.

14. Entire Agreement
